TERMS OF USE, RENTAL AGREEMENT & LIABILITY WAIVER
MR. BEACH RENTALS

PLEASE READ CAREFULLY. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND WAIVER OF LIABILITY. By reserving, paying for, or accepting equipment from Mr. Beach Rentals, LLC ("Rental Company"), you ("Renter") explicitly agree to the following terms.
SECTION 1: RENTAL POLICIES & FEES
1. EQUIPMENT DESCRIPTIONS & SUBSTITUTIONS

Model Variations: Mr. Beach Rentals frequently updates and rotates inventory. The images, colors, and specific models shown on our website are for illustrative purposes only.

Substitutions: We reserve the right to provide equipment that differs in brand, color, or model year from what is depicted online, provided the equipment is of comparable quality and serves the same functional purpose.
2. PAYMENT, INTEREST & COLLECTIONS

Payment Due: Full payment is required at the time of booking.

Late Payment & Interest: Past due amounts accrue interest at a rate of 1.5% per month (18% annually). If payment is past due by one (1) day or more, a full month’s interest—or a Minimum Finance Charge of $5.00, whichever is greater—will be added to the balance immediately.

Collection Costs: In the event Mr. Beach Rentals must retain a collection agency or legal counsel to collect past due amounts, Renter agrees to pay all costs of collection, including reasonable attorney’s fees and court costs.

Dispute Fee: If Renter initiates a credit card dispute (chargeback) that is resolved in favor of Mr. Beach Rentals, Renter agrees to pay an Administrative Dispute Fee of $50.00 to cover the administrative burden of responding to the dispute.
3. ACCIDENTAL DAMAGE PROTECTION PROGRAM Mr. Beach Rentals offers two tiers of coverage for accidental damage. Neither tier covers lost, stolen, or unreturned equipment.

TIER 1: STANDARD ALLOWANCE (INCLUDED)

Every rental includes a $25.00 Damage Allowance.

We will waive charges for minor accidental damage (e.g., cosmetic scratches, broken clips) up to $25.00.

Damages exceeding $25.00 will be charged to the card on file at the full cost of repair or replacement.

TIER 2: ADDITIONAL PROTECTION (OPTIONAL UPGRADE)

Cost: The greater of $10.00 OR 8% of the rental subtotal (plus tax), purchased at the time of booking.

Coverage: Covers up to $1,000.00 in accidental repair or replacement costs.

Exclusions: This protection does NOT cover:

Equipment that is lost, stolen, or not returned.

Intentional vandalism or destruction.

Damage caused by gross negligence or use prohibited by this agreement (e.g., dragging kayaks over asphalt).

TOTAL LOSS POLICY: In the event equipment is deemed a "Total Loss" (whether due to accident or negligence), Mr. Beach Rentals retains full ownership of the damaged item. Renters may not keep damaged equipment after paying replacement fees. Mr. Beach Rentals will dispose of the equipment at its sole discretion.
4. CANCELLATION & REFUND POLICY

24+ Hours Notice: Cancellations made more than 24 hours before the scheduled delivery time are eligible for a refund, minus a 3.5% transaction processing fee.

Less Than 24 Hours: Cancellations made within 24 hours of delivery are NON-REFUNDABLE. You may opt for a store credit (Gift Certificate) or a refund minus a 20% restocking fee.

Post-Delivery: No refunds will be issued once equipment has been delivered.

Weather: Weather-related cancellations must be made 24+ hours before your start time.
5. LATE RETURNS Equipment must be returned by the date and time listed on your invoice. Returns made past the scheduled time are subject to a Late Fee of $10.00 per order PLUS the daily rental rate for each item kept overtime.
SECTION 2: FRAUD & THEFT OF SERVICES
1. FRAUDULENT CHARGEBACKS Renter acknowledges that making a reservation, receiving the benefit of the rental services, and subsequently reversing the credit card charge without legal justification constitutes Theft of Services and Obtaining Property by False Pretenses under North Carolina General Statute § 14-100.
2. CARD VERIFICATION For your security and ours, Renters may be asked to present a valid Government-Issued Photo ID and the physical Credit Card used for booking upon delivery. The name on the ID must match the booking.
SECTION 3: LIABILITY WAIVER & ASSUMPTION OF RISK
1. ASSUMPTION OF RISK I acknowledge that water sports (kayaking, paddleboarding, etc.) involve inherent risks, including but not limited to: drowning, capsizing, hypothermia, changing tides, marine life, and equipment failure. I voluntarily assume ALL RISKS, known and unknown, of personal injury, death, or property damage.
2. RELEASE OF LIABILITY I hereby RELEASE, WAIVE, AND DISCHARGE Mr. Beach Rentals, LLC, its owners, employees, and agents from ANY AND ALL LIABILITY for any loss, damage, injury, or death, EVEN IF CAUSED BY THE NEGLIGENCE OF THE RENTAL COMPANY.
3. INDEMNIFICATION I agree to INDEMNIFY AND HOLD HARMLESS Mr. Beach Rentals, LLC from any claims, suits, or costs (including attorney's fees) arising out of my use of the equipment or the use of the equipment by any minors or third parties under my supervision.
4. MINOR CHILDREN If I am renting equipment for use by a minor (under 18), I certify that I am the parent or legal guardian of said minor. I consent to their use of the equipment, I assume all risks on their behalf, and I agree to indemnify Mr. Beach Rentals, LLC for any claims brought by or on behalf of said minor.
SECTION 4: LEGAL VENUE
GOVERNING LAW This agreement shall be governed by the laws of the State of North Carolina. Any legal action arising from this agreement, including collection of unpaid debts, shall be litigated exclusively in the courts of Brunswick County, North Carolina.
